As you can see while navigating https://citeesart.com , this site contains an eshop (hereinafter referred to as “Eshop”) from where you can buy t-shirts created by using your imagination and creativity with imprinted designs from touristic landmarks of all over the world available at the https://citeesart.com (hereinafter referred to as” Products”) or/and only digital files containing content of available designs (hereinafter referred to as “Designs”). At the moment you can create your own t-shirt by choosing from the selection of designs we have created for you and which is available in our Website, thus making products to your specifications and clearly personalized. In the near future you will be able to create your t-shirt by imprinting on it your own design/picture taken from your own trip.

1.3. Accessing and navigating in https://citeesart.com as well as purchasing Products and Designs, are actions subject to the present terms and conditions (hereinafter referred to as the “Terms and Conditions”). By browsing the Website and information provided therein and/or purchasing Products and/or Designs, the User/consumer (hereinafter referred to as “User” or “you”) accepts all current Terms and Conditions, as well as all changes and updates. In case you disagree or reserve your rights for a part or the total of the present terms, you are obliged to abstain from browsing in the page and purchasing Products or Designs. Otherwise you declare that you unconditionally accept the Terms and Conditions that govern our relationship.
1.4. Given that https://citeesart.com is not static but on the contrary it changes to meet our clients’ needs, it is highly advisable that you visit this page regularly to get informed about any changes made to the Terms and Conditions. Please note that any changes in Terms and Conditions do not apply to orders you have already placed through the E shop before terms’ change, but they are valid for the future use.
1.5. Our Website https://citeesart.com also contains links to other websites, which are not operated by our Eshop and which are not under the control of our Eshop, so we can not guarantee the accuracy, legality, completeness or quality of their content. The User is the sole responsible for accessing them and our Eshop bears no liability for those third party websites nor for any loss or damage that may be caused due to their use. While using third party websites you are subject to the terms and conditions which govern each website.
1.6. Please be informed that the sales contract conducted through our Eshop will be concluded in English.
2. Transactions through our Website and explanation of Website’s sections
2.1. Customized Products with imprinted touristic Designs of your choice and colour are made available for sale to you as a consumer through the online store of our Eshop. In addition digital content including Designs (not supplied in tangible mediums) is available to you through our Eshop as it will be explained in details in par. 2.2.
It is clarified that for distance contracts purposes, the law defines as:
a) consumer: every natural person who acts for reasons, which do not fall in the commercial, Business, craft or profession activity.
b) trader: every natural or legal person, regardless if it is governed by private or public law, who is acting, including through any other person acting in his name or on his behalf, for purposes relating to his commercial, Business, craft or professional activities.
Our Eshop is B2C and not B2B. Nevertheless the Website includes sections that solely address to Businesses/ traders such as Section “Make a Deal”, “affiliate area” “Wholesales”. In case of traders, the Website operates as a tool for the promotion of Products and Designs, for transactions conducted outside of the Eshop framework, while contract sales terms are defined by the specific agreement conducted each time between the Business and the purchaser/trader. Traders that are willing to order big quantities of Products are called to email us at the following email contact@citeesart.com
2.2. “Buy this Design”: Eshop enables User to buy only a selected Design, meaning only the Design and not the t-shirt on which the Design is imprinted so as to apply it in items the User chooses. By using the section “Buy this Design”, the consumer purchases digital content which is not supplied on a tangible medium thus by accepting the present Terms and Conditions, the consumer expressly consents and acknowledges that when the downloading of the file starts, he will lose his right of withdrawal. When the User buys Designs, he receives by e mail a zipped file ( type of file….) including digital content available to downloading and further processing. The User is able to process (modify etc) the Design he receives, only if he disposes appropriate graphic programs such as illustrator, photoshop etc. In case the User does not dispose appropriate graphic programs the Designs cannot be further processed by the User. Without prejudice to the present Terms and Conditions, the User can download and use the Design as many times as he wishes
2.3. Wholesales: This section of the Website https://citeesart.com addresses to the Traders and aims at promoting Business’s Products. In this section, there is an indicative pricelist of Products calculated for orders including over 100 Products. It is underlined that this pricelist is indicative and not binding. Special terms of the sale contract will be defined in the individual communication between the Business and the trader willing to purchase a quantity of over 100 Products.
2.4.Our Eshop reserves the right to choose at its sole discretion the Designs, which are available for print on the Products and the Designs sold through Eshop and to modify, renew or/and withdraw them at any time, without penalty and without prior information to the Users of the Website. The same applies for the colours of the Products. The same is valid for the prices of Products and Designs, offers and discounts, as well of the duration of the discounts (through coupons or not) which the Eshop may conduct in its sole discretion and which may change without prior User’s information (it is understood that this is valid prior to the contract conclusion with the customer). Eshop also reserves the right to change the countries to which orders are sent, unjustifiably and without prior notification of the User.
2.5. In any event it is pointed out that the EShop cannot guarantee the appropriateness of the Products or the Designs for the purpose that they are destined for. In addition in case of Designs the EShop cannot guarantee that the Design is appropriate for its application on other objects chosen by the User.
2.6. The Website gives the User the possibility to create personalized products by using his imagination to pick and choose a Design from our own selection of designs, relevant to the country the User chooses and imprint it on a t-shirt which will have a colour and size of his choice. In this way the User is enabled to buy a t-shirt he has created himself using his creativity and imagination made according to his specifications. Each t-shirt is made only by following User’s specific individual selection, order and specifications, thus the Eshop does not have any stock of Products and the User agrees by accepting the present Terms and Conditions that Products are custom made and that he cannot benefit from the right of withdrawal.
2.7. In the near future the User will be enabled to create and buy a t-shirt on which his own design will be imprinted.
2.8. Eshop has the right to deny the completion of any order (meaning to deny the conclusion of a contract) to any User for any reason. The same is valid in case a User acts illegally or breaches the terms of the Website or the sales contract.
2.9. The User accepts any insignificant declination of the colour of Products, imprinted Design or the Design itself through the acceptance of these Terms and Conditions.
3. Terms and stages of purchase completion.
3.1. By making an order through our Eshop, you agree to abide by the present Terms and Conditions. We would like to underline that the present Website does not consist a proposition to the consumer to execute a contract with our Eshop; instead it constitutes an invitation to the consumer to submit a proposition (to the Eshop) in order for the Eshop to accept. The stages of the procedure starting from the order placement by the User till the execution of the contract between the User and the Eshop are the following:
Α. After entering our Eshop, you can choose a country and city from the ones already mentioned in our list and then choose from the Designs already available for that city. Otherwise you can directly choose a Design from the ones appearing at the Website. Following that the User can choose the colour and size of the t-shirt or just the Design in case the User wants to buy only the Design. Following the selection of User and in order to facilitate him, our Eshop shows a model wearing the t-shirt that bears the characteristics that the User has chosen to apply to the Product. Kindly take under consideration that this presentation of the t-shirt is made only to facilitate User’s choice. The purchased Product or Design may be slightly different from the one depicted on the model or the one appearing on the Website due to technical reasons (screen analysis, photographic representation etc). After choosing your Products or Designs you can also calculate shipping rates by using the calculator tool that is available to inform you about the shipping costs based exclusively on the shipping details submitted by you (meaning country, post code etc). Further to that, you are asked to fill in customer information. This data is necessary for the completion of the transaction and execution of the contract. Filling in all necessary information among which payment method and since you are willing to submit an order for the purchase of the customized products you click on the button ‘order with obligation to pay[a1] ’. In this way you submit your proposition for the conclusion of a sale contract (including the Products and or Designs you have chosen) to the Eshop.
Β. Following your order placement, you will receive in the email registered by you during the order placement procedure an automated message of confirmation that our Eshop has received your order and the order is being processed. This confirmation message of order reception sent by the Eshop is the acceptance of your proposition and constitutes our sales contract.
C. Following that (in case of Products), the Eshop sends you an e mail to inform you that your order has been shipped to the registered address and informing you at the same time about the track number of the shipment with which you can track your order anytime.
D. In case of Design, following the completion of the order and the proper completion of payment procedure, the User will receive a mail in which a zipped file with the Design is attached. The file can be further processed by the User on condition that the User has installed in his hardware appropriate graphic programs (i.e. illustrator, photoshop etc) that enable further processing of the file. This message sent by the Eshop is the acceptance of your proposition and constitutes our sales contract. Please be informed that if the User has not installed such programs he will only be able to download the file and not further process and modify it. Paragraphs A and B are also applicable.
In case we face any problem while processing your order (i.e. availability of t-shirts etc) we will contact you to inform you by e mail at the address registered at by you during the order placement procedure.
For the completion of the order, you give your consent for the processing of your personal data in order for you to receive information regarding the progress of your order, through the acceptance of the present Terms and Conditions. When making an order, you declare that all details provided by you are true and accurate, that you are the authorized holder of a credit or debit card used to pay and that that the balance is sufficient to cover the price of the product and delivery expenses. The delivery of your products is governed by article 7 below.
3.2. Given that our business does not have stock of products but all Products are custom made following your selection and order specifications, we would like to inform you that manufacturing time for the ordered products is 24-48 hours starting from the reception of the order. Shipping time does not include manufacturing time. Thus please allow the above mentioned manufacturing time of 24-48 hours in addition to shipping time needed according to your delivery address. Please be informed that delivery time is also subject to delay caused by post or transport companies, for which we are not liable. For further information, you are kindly asked to run through article 7 regarding delivery arrangements.
3.3. To be able to proceed to a transaction through the website, you should be over 18 years old. Visitors under 18 should abstain from any action taking place in https://citeesart.com.
3.4. Eshop is not liable in case the buyer does not receive the Product on the agreed day at his fault or in case of non timely delivery of the product due to force majeure.
3.5. Risk transfer
a) If you are a consumer and if you have ordered, the transporter to transport the products and this choice was not given by us, then according to the law, the risk is transferred to the client at the time of the delivery to the transporter, without prejudice to consumer’s rights against the transporter.
b) If you are a trader by placing your order and by requesting to deliver the products to you, you are ordering the Eshop to send the products to be sent to a place different than the place of the contract execution (namely the Eshop premises), hence you are liable for the product since it is provided for delivery.
3.6. For any issue occurred while processing the order, we will contact you (by mail to the contact details provided by you).
4. “Make a Deal” Section
A. Through the Website the User has the possibility to view a large selection of interesting Designs. Users interested in ordering more than 10 Products or for Users interested in creating absolutely personalized Designs or to proceed to other type of special orders are called to contact us at contact@citeesart.com It is underlined that the Website is not a proposition to the User to conclude a contract but an invitation to the User to submit a proposition. In case of “Make a Deal” the sales contract can be concluded in whole or partially with electronic means (email) or telephone, fax. In such case the Website does not operate autonomous and independently but as a supplementary means of Products’ promotion and orders’ submission by the customers of the Business. In case of “Make a Deal”, every order is received by the business without prejudice to the checks of t shirts availability or Business’ s capacity for the execution of proposition, price, delivery time etc conducted.
Β. Checks conducted through the Business: As long as the User submits an order, the Business will proceed to the check of availability, price definition at Business’s free will (determined by a variety of factors such as Products quantity) and delivery cost calculation and delivery time calculation.
C. Order completion: Following the abovementioned checks conducted, the order is completed following the individual communication of the Business with the User/buyer (email, telephone or otherwise) where specific terms of the sale are defined such as product price, delivery time, delivery costs as well as special arrangements as to the delivery of the Product. The Business is not obliged to conclude a sales contract with the User that submits his proposition for “a make a deal” transaction.
5. Prices, discounts and coupons
5.1. User consents that the Eshop maintains the general right to set its pricing policy as well as to freely change it at all times, to modify the quoted prices on the Website and pricelist appearing on Wholesales section and to change and/or withdraw the offers at any time as well as withdraw or modify discounts through coupons acquired by affiliate companies without prior notice to Users, who will be informed about the current price through the relevant posting on the website. Whilst we try to ensure that all details, descriptions and prices displayed on this Website are accurate, unfortunately errors, typos or other inaccuracies may occur. We therefore reserve the right to make corrections to any errors, inaccuracies or omissions and to change or update information on the Website at any time without prior notice. We also reserve the right to refuse processing any orders that you have placed based on information that may contain errors or inaccuracies, including, inter alia, errors, inaccuracies or out-of-date information. We urge you to notify us in case that any such error comes into your attention.
5.2. Product prices include VAT and for your convenience can be displayed in other available currencies provided in the Website. We would like to inform you that it is not possible to check and modify the corresponding pricing depending on the every day exchange rates thus price calculation in other currencies is indicative and final charge may be slightly different from the price estimation in other currencies. Shipping costs will be additionally charged and you will be notified of the cost while placing your order at the Website. Shipping cost calculator tool is made available only to facilitate Users, thus Eshop cannot guarantee the accuracy of the calculated amount because it is beyond the Eshop’s control. Quoted prices do not include additional expenses of delivery, post etc which are calculated and are notified to the User during the order placement procedure, Quoted prices do not include fees, taxes and expenses possibly applicable by tax or other authorities, organizations, public services etc. In addition quoted prices do not include and thus the client may be obliged to pay other banking transaction expenses applicable. We cannot calculate banking expenses in advance since they are based on the pricing policy of the banks.
5.3. User can take advantage of discounts applicable to the Products, by inserted coupons that has received from affiliate companies. Our Eshop reserves the right to choose at its sole discretion the percentage of discount offered with the use of coupons, the products on which coupons’ discount can apply as well as the companies from which Users can take coupons and modify or/and withdraw coupons at any time, without penalty and without prior information to the Users of the Website.
6. Payment arrangements
6.1. For your convenience, you can choose between the following payment methods:
a) Visa, Master Card, MasterPass, Maestro, American Express, Diners credit card, debit card, prepaid card: Our Eshop, aiming at the maximum possible transactional security, has the possibility (but is not obliged) to check through the payment service providers the correctness of the payment details sent by customers (when payment is made through credit cards) at the stage of order completion and connection with the third payment services provider and can reject the order if there is or is likely to exist any problem in relation to these details. All payments made with the use of a card are completed through electronic payment platform “Alpha e- Commerce” of “Alpha Bank” which uses TLS 1.1 encryption with encryption protocol 128-bit (Secure Sockets Layer –SSL). Encryption is a way of information codification until the information reaches its recipient, who will be able to decode it with the use of the appropriate key.
b) paypal: In case of payment through paypal, a third company with which you have personally contracted for the provision of those services, your relationship with paypal is independent from the contractual relationship you hold with the Eshop and thus it is governed with the specific terms applicable to paypal (to whom our business does not participate as a contracting party).
6.2. If you have chosen to pay by credit card, please be informed that the procedure is completed by a trusted partner accredited payment institution, which based on its declarations has taken all necessary means to safely conduct electronic payments. Payment details are processed by partners payment institutions which are exclusively liable for the processing that is necessary for the completion of the payment.
6.3. In case you choose to pay by card, the holder of the card should be present during the delivery of the order and you are advised to hold and to show the card and his identity card. In case a third person shall receive the order, you should have prior notified the Eshop that he/she will receive the Product. Otherwise the Eshop reserves the right either to refuse delivery or to deliver the product at the registered address and to person that is present in that address. In case the order is placed on behalf of a company and company details were used, then the card used should belong to the company which means that it should be issued on the company details or to a person who has the power to represent the company in this purchase agreement. In any case it is your responsibility to undertake all the reasonable measures to ensure that the product shall be delivered to an authorized person.
7. Delivery arrangements
Products are delivered in the countries of all over the world. Eshop has the right to alter countries to which deliveries of the products are made without prior notification of the User. Delivery arrangements and shipping expenses are determined according to the following way:
7.1. Free shipping of Products in countries all over the world for orders over 50 euros (including VAT).
In case the amount for your order exceeds the amount of 50 euros (including VAT), our Eshop will send your order for free regardless of your delivery address (meaning regardless of the place that the delivery address is located. The order will be delivered with registered post. Orders are delivered within 3-5 business days to Europe and 6-12 business days to the rest of the world. The above delivery deadline does not include manufacturing time thus please allow 24-48 hours in addition to delivery time. Our Eshop will properly inform the User by sending mail at the registered mail of the User to inform him that his order has been shipped along with track number to track the shipment any time.
7.2. Shipping of Products under 50 euros (including VAT):
In case the price of your order is under 50 euros (including VAT) shipping costs apply depending on the delivery address and costs will be calculated by using shipping tool calculator during the order placement procedure. The cost is calculated depending on the details (country and post code) you fill in the Eshop system. Please note that all delivery/shipping expenses should be paid exclusively by the User. In case you use this method the order will be delivered at the shipping address you have registered in the Eshop’ s system while placing your order. The order will be delivered with registered post. Orders are delivered within 3-5 business days to Europe and 6-12 business days to the rest of the World. Shipping costs for Europe are 5 euros and for the rest of the world 8 euros regardless of the order’s weight. The above delivery deadline does not include manufacturing time, thus please allow 24-48 hours in addition to delivery time. Our Eshop will properly inform the User by sending mail at the registered mail of the User to inform him that his order has been shipped and track number to track shipment any time. Expenses can change in the future without User’s prior notification. In such case costs will be uploaded on the Eshop’ site.
Our Eshop reserves the right to use other transport instead of registered post without prior User’s information.
7.3. Disclaimer of responsibility in case of delivery arrangements.
We cannot guarantee the timely delivery of the products since delivery is made through post or a third Transport Company. The delivery time is exclusively defined by the post or the transport company depending on the delivery address. In any event Eshop processes the orders and produces the custom made product within 24-48 hours from the day the order is placed in our Eshop. In any event that the delivery time initially notified to you changes, we will contact you to inform you accordingly. In case the delivery should take place within a specific deadline or time, we kindly ask you to contact us at the e mail address contact@citeesart.com or to include a note in the order notes, so as to inform us accordingly about this date to avoid any possible problems in relation to products that may be unavailable. Otherwise standard delivery time schedules shall apply.
8. Lack of applicability of the right of Withdrawal valid for Products and Designs.
8.1. Given that Products are produced following User’s specifications (in design, colour and size) specified in User’s order and thus are clearly personalized, the User/buyer/consumer does not have the right of withdrawal for Products since it falls within the exception of article 3 l, par. c of the law 2251/1994.
8.2. Given that by buying Designs, the consumer buys digital content which is not supplied on a tangible medium and its performance has begun with the consumer’s prior express consent and his acknowledgment that he thereby loses his right of withdrawal, User/buyer/consumer hereby expressly consents to the immediate execution of the contract and accepts that he will lose the right of withdrawal from the contract when downloading of the digital content starts according to article 3 l, par. m of the law 2251/1994.
9. Your rights in case the Product has an actual defect
9.1. We aim at providing maximum customer satisfaction. However, if you receive a faulty product or a product with lack of guaranteed qualities you can exercise the rights laid down to the Greek Civil Code at your own choice and specifically: 1) you can request without charge the correction or replacement of the product unless this is impossible or requires disproportionate costs, 2) price reduction, 3) you can withdraw from the contract unless there is insubstantial fault and if when the risk goes to the buyer there is lack of guaranteed qualities of product, buyer is entitled, instead of the rights which were mentioned above, to request compensation for non-execution of the contract or cumulatively to these rights, to request compensation for the damage which is not covered by the exercise of those rights. The same applies in the case of defective product, due to Eshop’ s fault. 9.2. In all cases of return of products due to actual fault or proven lack of agreed property due to our fault, the following shall apply:
i) The returned products can only be sent to https://citeesart.com at the following address 8 Anapafseos str. Piraeus Greece, Post Code 18654
ii) For a return to be accepted the product has to be preserved in the proper storage conditions.
iii) The returned products should be accompanied by the Retail Receipt otherwise we will not be able to satisfy your request.
10. Prohibitions when accessing and using the Website
10.1. You are connecting to https://citeesart.com via providers and means of your free choice. By browsing to our website you are committed to accept the present terms and conditions, to act in legal way without damaging our reputation or taking advantage of it, and you must not imply in any way any form of association, approval or seal of approval on our part where none exists. You should not establish a link to any Webpage that you do not own. The Website https://citeesart.com must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without prior notice.
10.2. You shall not misuse this Website, hinder or interfere in any way to the operation of the Website or replace or modify its content. You are obliged not to commit or encourage a criminal offence, transmit or distribute viruses, or post any other malicious or technologically harmful material and you abstain from committing any actions that can lead to unacceptable or extensive damage to the infrastructure or operation of the https://citeesart.com . Furthermore, you shall not use the website in breach of confidence or in any offensive or obscene way.
10.3. To the maximum extent not prohibited by Greek law our Eshop as well as our contractors and or producers and advertisers make no representations, promises or warranties of any kind, express or implied about the completeness, accuracy, suitability for a particular purpose with respect to the website or the information, Products and Designs sold by the Eshop. Eshop takes no responsibility and expressly disclaims liability for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods, arising directly or indirectly out of or in connection to your use of or inability to use this Website or any of the content included there in or content included in the Linked Sites.

Eshop excludes any liability for loss or damage that may be provoked by viruses or other harmful material or malicious attack that may cause damage to your property in general (either hardware, software, data or other proprietary material) due to User’s access to the Website or the downloading of any content available on this or other linked websites.

12. Intellectual Property, Software and Content
12.1. The Eshop and its collaborators reserve all rights (including intellectual property rights, trademarks and any other intellectual property right) related to the material included in the Website https://citeesart.com , Designs appearing on the Website and imprinted on Products and/or to the material accessed through the Website (indicatively including trademarks, Designs, photographs, texts etc). The EShop and its collaborators/licensors are also the owners of intellectual property rights of the software necessary for the operation of this Website.
12.2. You are not allowed to copy in whole or in part, publish, handle, distribute, transfer, alter, store, re-publish, modify or otherwise reproduce, in any format, any part of the material or copies of the material of this Website (including Designs available to be imprinted on the Products) with the sole exception of Designs sold separately, where you are given the non exclusive permission to download them, process them and apply them on the object you want. You are not allowed to use any material included or accessed through the Website in relation to any commercial activity without receiving the Eshop’ s previous written permission (with the exception of Designs as abovementioned). You may download and print the material of the Website only for personal use. Your limited license to access and use the Website does not allow you to use any trademarks included to Eshop (whose owners are either the Eshop or its collaborators) or any Designs available at the Eshop with the exception of the Designs purchased separately through section “Buy this design” as abovementioned. Furthermore, you may not modify, translate, reverse engineer or create derivative works using the software available for the operation of this Website. The User should not alter, modify or use the Design in an illegal, offensive, abusive way or in a way that may harm all type of legitimate interest of the Business. In case a Design is used by a User in an illegal way or in a way that harms Business’s legitimate interest, the User is liable to fully compensate the Business and any third person for any damage suffered.
12.3. Photographs of products

The previous are applicable whether such claims, losses or damages arise in tort, contract, negligence, under statute or otherwise. 18. General Clauses
18.1.This Agreement represents the entire understanding between the Parties. Neither Party will be liable for any misstatement or misrepresentation whether made innocently or negligently however this clause does not restrict liability for misstatement or misrepresentation made fraudulently.
18.2. All disputes between the Eshop and the Users on any issue that may occur because of or in connection with the provision of Products or Designs or the use of the Website shall be governed by the Greek law. The parties expressly hereby agree that the Courts of Athens shall have the exclusive jurisdiction. You declare and accept as legal and lawful any bailiff or receipt of any judicial or extrajudicial order at the address you have declared as your address while registering in the EShop.
18.3. If any term of the contract is held to be abusive or is invalid, this does not affect the other terms of the contract, which shall remain valid and binding to the parties (including any provision in which we exclude our liability towards you). So far as possible where any clause/sub-clause or part of a clause/sub-clause can be taken into account separately to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be corrected and interpreted so as to closely resemble the original meaning of the clause /sub-clause as is permitted by law.

In no event will any delay, neglect or forbearance on the part of either party in enforcing (in whole or in part) any provision of this Agreement be or be deemed to be a waiver thereof or a waiver of any other provision or will in any way prejudice any right of that party under this Agreement.
